For a lot of families we talk to, the decision to leave the U.S. isn't really about scenery or cost of living. It's about wanting their kid to grow up somewhere that doesn't feel like a fight. That's a real and reasonable thing to want, and it deserves real answers, not just a general reputation.

Start with the reputation, then look past it. Portugal and Spain are both widely described as LGBTQ-friendly, and for a lot of day-to-day life, that holds up. But "friendly country" is a broad brush, and the legal specifics that actually matter for your child's healthcare can be more detailed, and can change faster, than that reputation suggests.

Spain's legal framework is currently clear and stable. Under Spain's 2023 trans law, there's a defined, self-determination-based process for legal gender recognition, with specific provisions for minors at different ages.

Portugal's legal framework is currently in transition. In March 2026, Portugal's Parliament repealed the 2018 law that let 16-17 year-olds update their name and gender marker with parental consent, and additional proposals that could restrict access to hormone therapy and puberty blockers for minors are still being debated.

That doesn't mean cross Portugal off the list. Many families still find real advantages in Portugal, from cost of living to community to pace of life, and general nondiscrimination protections remain in place. What it does mean is that if your child's healthcare plan depends on ongoing gender-affirming care, that piece may need to happen in Spain, even if your family is based in Portugal, at least until Portugal's situation settles.

Build your plan around current law, not last year's article. This is a fast-moving area right now, on both sides of the border, and the right plan for your family depends on details that are worth confirming directly rather than assuming.

You don't have to sort this out alone, and you don't have to get it perfect on your own before you reach out. A conversation with someone who's tracking both countries' healthcare and legal landscape in real time can save you from building a plan around information that's already changed.
